FACT SHEET: FSP LICENSE

We are pleased to inform you that the Financial Services Conduct Authority (“FSCA”) of South Africa has approved BCFS’s application to operate as a licensed Financial Services Provider (“FSP”), effective 28 October 2025, under license number FSP 55147.
Given that the FSP license is subject to the requirements of the Financial Advisory and Intermediary Services Act, 2002 (“FAIS Act”), and the specific licensing conditions set by the FSCA, this fact sheet aims to provide more details regarding the FSP license and its application within the BCFS environment.

- APPLICATION OF THE FSP LICENSE IN THE BCFS ENVIRONMENT
The FSP license only applies to the intermediary services BCFS provides to its Institutional Investor portfolio and the financial products introduced through BCFS’ Special Purpose Vehicle (SPV) structures. BCFS may on render intermediary services to its SPV structures in respect of the financial product categories they are licensed for and as listed in 1.3 above.
The FSP license does NOT apply to the loan assets offered in the private lender environment.
- REGULATORY FRAMEWORK
BCFS’ key regulatory framework now includes the following:
- 3.1 National Credit Act 34 of 2005 – registered as a credit provider with registration number: NCRCP 11132 reporting to the National Credit Regulator.
- 3.2 FAIS Act – as set out in 1 and 2 above reporting to the FSRA.
- 3.3 Financial Intelligence Centre (“FIC”) Act 38 of 2001 – an Accountable Institution in terms of categories 11 and 12 listed in Schedule 1, reporting to the FIC.
- 3.4 Protection of Personal Information Act, a South African data privacy law (Act 4 of 2013) and Promotion of Access to Information Act 2 of 2000 – reporting to the Information Regulator.
